Terms of use

These terms govern your use of the Plate app on iPhone. By installing or using the app, you agree to these terms. If you do not agree, do not install or use the app.

1. License

Sector 42 Limited grants you a non-exclusive, non-transferable license to use the Plate app on Apple-branded products that you own or control, in accordance with the Usage Rules in Apple's Media Services Terms and Conditions. This license does not allow you to redistribute the app, make it available over a network, or sell or sublicense it. The app, including its embedded models, remains the property of Sector 42 Limited. This license ends automatically if you breach these terms.

2. Free tier and Plate Pro

Plate is free to download and includes every feature, subject to two limits: how many recipes your library may hold, and how many AI-assisted imports (photo, PDF, and text) you may run in a rolling seven-day period. The limits in force are shown in the app.

Plate Pro is a one-time, non-consumable in-app purchase that removes both limits. It is not a subscription. Apple sells it and handles the payment, the price is shown to you before you buy, and it is eligible for Family Sharing, so members of your Apple Family group can use it. Use Settings ▸ About ▸ Restore Purchases to re-apply it after a reinstall, or on another device signed into the same Apple Account.

If you bought Plate while it was a paid app, you have been automatically upgraded to Plate Pro at no further cost.

Reaching a limit does not affect content you already have. Your recipes stay on your device and in your iCloud library, readable, editable, and syncing; only adding new recipes beyond the limit is refused. If Apple refunds a Plate Pro purchase, the limits apply again. Your content is not deleted.

We may change the limits that apply to the free version, and the price of Plate Pro, in a later release. A purchase you have already made is not affected.

3. Permitted use

Plate is intended for personal, non-commercial use: storing your recipes, planning meals, building a shopping list, importing recipes you find, and sharing recipes with friends and family.

4. Restrictions

You may not:

  • reverse-engineer, decompile, or disassemble the app, except to the extent permitted by law;
  • redistribute the app binary or any of its embedded models;
  • circumvent, or attempt to circumvent, the free-tier limits or the checks that determine whether Plate Pro is unlocked;
  • use Plate's import features to access third-party websites in a way that violates those sites' terms of service or applicable copyright law.

5. Your content

Recipes, photos, notes, and other content you create or import using Plate remain yours. Sector 42 Limited makes no claim of ownership over your content. You are responsible for respecting the copyright and license terms of any recipe content you import from third-party sources.

6. AI-extracted content

Plate uses on-device machine learning to read and import recipes. Extraction is best-effort and may contain errors. Verify ingredients and quantities against the original before cooking, especially when allergens or precise measurements matter. Sector 42 Limited is not liable for cooking outcomes that result from incorrectly extracted content.

7. Service availability

Plate's iCloud sync depends on Apple's services and on your network. Sector 42 Limited does not operate Apple's infrastructure and does not guarantee its uptime. Your data remains on your device whether or not iCloud is available. Buying and restoring Plate Pro likewise depend on the App Store being reachable. The quality-report service is operated by us and may be rate limited or unavailable at times.

8. Quality reports

If you tap Report when an import doesn't work as expected, Plate sends an encrypted diagnostic bundle to our servers. This is opt-in per report: you choose whether to send it at all, and when to send it. When you use this feature, you agree not to:

  • submit spam, malware, content that infringes others' rights, illegal content, or anything unrelated to a genuine import problem;
  • circumvent the App Attest verification, submit at abusive volume, or run automated submissions outside the app's normal flow.

We may rate-limit, refuse, or delete submissions that breach these conditions. This does not affect your use of the rest of the app.

9. Disclaimer of warranties

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, Sector 42 Limited's total liability arising out of or related to your use of Plate is limited to the amount you paid for the app and for any in-app purchase, if any. In no event will Sector 42 Limited be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these terms limits rights you have under laws that cannot be excluded by agreement, including the New Zealand Consumer Guarantees Act 1993 where it applies. Sections 9 and 10 apply only to the extent those laws allow.

11. Apple as a third-party beneficiary

You acknowledge that these terms are between you and Sector 42 Limited, not with Apple, and that Apple is a third-party beneficiary of these terms with the right to enforce them against you. Apple is not responsible for the app or its content, and has no obligation to address any claim relating to the app or your use of it.

12. Maintenance and support

Sector 42 Limited is solely responsible for providing any maintenance and support for the app, as required by applicable law. Apple has no obligation to furnish maintenance or support.

13. Refunds

If the app or an in-app purchase fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.

Apple is the merchant for both the app and Plate Pro, so refunds are requested from Apple and granted by Apple. We cannot reverse an App Store charge ourselves, though you are welcome to write to us if something has gone wrong.

14. Legal compliance

You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and that you are not on any United States Government list of prohibited or restricted parties.

15. Governing law

These terms are governed by the laws of New Zealand, and disputes may be brought in the courts of New Zealand. If the law where you live gives you mandatory consumer rights or the right to bring a claim in your local courts, these terms do not take that away. If any provision of these terms is found unenforceable, the rest remain in effect.

16. Changes to these terms

We may update these terms from time to time. When we do, we will update this page and the "Last updated" date at the top. If you keep using the app after a change, you accept the new terms.
